John H. Kolessar and his spouse have sued Bay City and are asking damages in excess of $497,000 include lost wages and benefits, interest, attorney fees and other costs.

James M. Palenick verbally assured Kolessar job security.

Kolessar tried to apply his 'bumping' rights but was not given any position.

Kolessar claims that if he had been younger he would not have been fired.

Kolessar claims he suffered loss of earnings and earning potential, humiliation and embarrassment, mental and emotional distress, and loss of the right to pursue gainful occupation of choice.

Barbara Kolessar claims that she became severely depressed because of the actions of the city, causing stress, anger, loss of sleep, hysterical crying, changes in character and wide mood swings.
